Introduction

This website is owned and operated by HomePoint PTY LTD, a company incorporated in South Africa with registered number 07101408 and whose registered address is 25 Edge Road, Beacon Bay, East London, South Africa. This is the user agreement that governs your use of this website and the provision of the services we provide you. We reserve the right, at our sole discretion, to change, modify, add, or delete portions of these website terms at any time without further notice. If we do this, we will post the changes to these website terms on this page and will indicate at the top of this page the date these terms were last revised. Your continued use of the website after any such changes constitutes your acceptance of the new website terms. It is your responsibility to regularly check the website to determine if there have been changes to these website terms and to review such changes. Please do take time to read these terms as it is important for both of us that you understand our contractual relationship both relating to your use of our website and the services we provide you. You will be asked to check a box that states you’ve agreed to our terms and conditions on the check out page. Prevailing laws for settling dispute will be based on the location of the company corporate headquarters.

Description of products

All products available for purchase are described on their specific product page on our website. We always try to represent as accurately as possible every characteristic of the products via photography and copy points provided by designers, suppliers or manufacturers.

We reserve the right to amend the specifications of products, their price, packaging and any service associated at any time, without prior notice. Before ordering, we thus invite you to have a close look at the product description and characteristics: we choose them with care in order to provide you with the best offer in the market, but every product is different and you have to make it yours.

We try our best to provide you with the best images and closest description, but unfortunately cannot guarantee that colours and details in website images are 100% accurate representations of the product, and sizes might in some cases be approximate.

Even if not always mentioned, some self-assembly may be required on certain products.

Sales

The products displayed on our website are on sale for a specific sales period that is clearly notified on the product page. Nonetheless, so as to give you access to the best possible choice of products, the popular ones might be promoted for an extended period of time. During the whole sales period process, we do group orders together. Consolidating orders enables us to bring you the best possible price.

If an order is delayed or is unable to be placed for any reason we would do our best to notify you. Should we be out of stock for the particular items you have selected to purchase, we would remove it as quickly as possible from our website. Should you have placed an order for that specific product, you would be notified by email of the situation, your order would be cancelled and you would be reimbursed in full or alternatively if you so wish to wait for the new stock to arrive.

Prices

All prices are in Rand (ZAR), and are payable Rand (ZAR), plus applicable VAT. These do not include delivery costs to other country and do not include delivery costs in South Africa unless otherwise specified, or possible special or extra charge. These additional prices will be added upon checkout before making payment and appear in your order confirmation page.

We try our best to indicate the best comparable prices for each specific product. These comparison prices refer to market prices benchmarked for identical or comparable items. They are only estimated prices, and always depend on quality of material used, attention paid to the finishing of the products, retailing location and other issues.

Purchase of products

Your order(s) represents an Offer to Purchase to us for a product(s), which is considered accepted by us once an order confirmation is emailed to you. Any product that does not appear on the order confirmation email does not form part of that Offer to Purchase. HomePoint shall under no circumstances be held liable for any special losses to specific circumstances of the customer, indirect or consequential losses and/or for loss of profits, damage or property, or wasted expenditure.

Orders are placed and received exclusively via the Internet and processed by HomePoint Pty Ltd.

Before ordering from us, it is your responsibility to check and determine your full ability to receive the products. This includes ensuring that the product ordered will pass freely into your room of choice, and that they fit in that room, can be transported through the front door of your flat or room, stairs and doorways, and any other issues that could make the delivery impossible. Up-to-date mobile telephone number and e-mail address are absolutely necessary to ensure successful delivery of your item.

All information asked on the registration page must be filled in precisely and accurately. HomePoint cannot be held responsible for costs as a result of missed delivery due to wrong address and/or incorrect phone number supplied and/or inaccessibility of both at the time of delivery. All additional charges or costs due to delivery complications or missed delivery would thus be added to your order invoice.

How are we capturing the clients’ information? On registration? Must a client register as a user before purchasing can take place?

Payment

Your debit or credit card is charged for the whole amount of the order when the order is created. HomePoint uses one of the most powerful security systems on the Internet in order to protect all significant data related to payment.

A credit card and necessary information is needed for payment. All orders are paid only through Pay Gate or by credit cards issued by companies listed on the payment page.

Electronic Fund Transfer (ETF) is also acceptable; please ensure the correct order number is used as the beneficiary reference for payment.

Will we have order numbers for each order?

The sale will be submitted for processing as soon as you click on the “Place Order” button. You will then receive an email from us to confirm the sale, availability of the product, and expected delivery within 10 working days.

We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of refusing or by reason of unwinding? Or suspending any transaction after processing has begun.

Delivery

We deliver to all major centers in South Africa. We do not currently deliver outside the South Africa. Delivery prices will vary depending on delivery location, and additional charges may be added to the order for remote or difficult to access locations that require special attention.

Depending on the item’s weight, size and quantity, different carriers and services might be used to deliver your order. In some cases, mainly related to larger items, we will offer premium service for which the carrier will contact you and set up a mutually agreed upon delivery time.

Delivery lead-time may vary depending on the products ordered and Courier Company used. While some delivery can take longer, others could be delivered much faster. All delivery estimates given at the time of placing and confirming order are subject to change. In any case, we will do our best to contact you and advise you of all changes. HomePoint also provides customers with a tracking number with which you may track the progress of delivery with the respective courier companies. We try our best to make this tracking tool as accurate as possible with the information we have in hand.


Stock shortages

  • In the event of a temporary out-of-stock situation, you shall be entitled either to cancel the order and be fully refunded, or to maintain the sale subject to a later delivery date as may be agreed;
  • In the event of a permanent out-of-stock situation, you shall be entitled to be fully refunded.

In being ‘fully refunded’ as aforesaid, you will be refunded the relevant purchase price and delivery charges, without having to pay any administrative or other charges.

Late deliveries

If a product purchased is not delivered within the agreed delivery period, or where no specific period was agreed, within 30 days after having purchased the Product, the SA ECT Act entitles you to cancel such sale on 7 days notice to the seller of such product, via email notification to return@homepoint.co.za

Should a product purchased be unavailable, we will notify you and issue a full refund within 30 days after such notice.  Or we will make alternative arrangement with you.

Return Policy

We are working very hard to provide you with the best quality products at the most affordable price, and truly wish you will be pleased with the product you order from our website. However if for any reason you are not, please follow the following instructions for returning the goods purchased.

Please open and check your order on the day of receiving it and inform us of any transit damage problems immediately. All items and parts of items must be checked for any damage prior to assembly. It is your right and responsibility to check that your delivered products have arrived in perfect condition, before signing the delivery form.

If for any reason listed below, you wish to return your goods purchased, you must notify us by contacting our Customer Service team by sending an email to return@homepoint.co.za with the order reference number, a quick explanation of the reason why you wish to return the product, and any detail you consider important. We aim to answer emails within two working days. Our customer service team will then contact you to arrange for collection and explain all the necessary procedures.

1. Early cancellations

Except for made-to-order items where production has begun, you may cancel (either in whole or in part) any sale without attracting any cancellation and/or administration charges if you cancel prior to the packaging of the products ordered.  Such early cancellations can only be effected via email notification to return@homepoint.co.za

If your order is cancelled timeously and before packing and dispatching of the order, you will be fully refunded in respect of such cancelled sale including delivery charges.

2. Change of Order

If an order is only partially changed or cancelled and delivery charges as re-calculated on the value of the amended order exceed the delivery charges as calculated on the original order, you will be liable for the additional delivery charges, or alternatively be eligible for a refund of the over-charged portion of delivery charges.

3. Incorrect Products

If incorrect Product is delivered to you by mistake (i.e. it is not the Product you purchased), please do not remove the Product from its original packaging, open or use the Product in any way. Within 24 hours of delivery, please contact us at return@homepoint.co.za, so that we rectify the mistake by arranging to collect such Product from you and deliver the correct Product to you, as quickly as possible at our expenses.

4. Damaged products

NB: You should refuse to accept delivery of any product which is visibly damaged, and if you only discover the damage after the courier has left, then you must report it to Homepoint as soon as possible and within 24 hours. If only reported after 24 hours, it is reasonable for Homepoint to determine that the damage was caused post delivery; As a result, HomePoint will NOT process any return, replacement and refund.

If the delivered item is damaged, please contact us as soon as possible to arrange a refund or replacement. HomePoint must be notified of damages within 24 hours of delivery. We will ask you to send us a photo of the damage for our records and to assist us in taking appropriate action. We will require you to return the item with care, as it might be necessary to return it to the manufacturer. Please include your customer order details with the package, as these are necessary for processing a return. Once HomePoint receives returned goods, the items will be checked and assessed to determine the cause of the damage;

  • Should the damage be caused by the courier company and/or product defects, our customer service will contact you to advise you of the possible replacement. Should a replacement be not available, HomePoint will refund your purchase price in full including delivery charges.
  • ·         Should the damage be caused post delivery by the client HomePoint will NOT process any return, replacement and refund.

 

5. Defects under warranty

If, within 6 months after delivery of a product to you, you Find that the product is defective/faulty, unsuitable for the purpose for which it was indicated in the product description or otherwise generally intended, not legal, or not reasonably durable, based on circumstances and product type (hereinafter referred to as being “Defective”); you need to inform us and we will arrange to return such product to homepoint.co.za for inspections. Should the product be subsequently find:

  • To indeed be defective, you are entitled to
    • Have the product repaired
    • Or replaced at HomePoint’s expense,
    • Or be fully refunded;
    • NOT to be Defective, you will be liable for the costs incurred in having such product returned to HomePoint and then re-delivered to you.

Following issues/problems will NOT render the product Defective and will not entitle you to any repair, replacement or refund:

  • Faults resulting from normal wear and tear;
  • Unauthorized person(s) has altered, attempted to repair or damaged the product without acknowledgment and consent from HomePoint.

6. Non-defective products: Post-Purchase-Remorse

If you change your mind for any reason and wish to return your purchase, you need to notify us within 7 days of receipt by contacting our Customer Service team by sending an email to return@homepoint.co.za. You have a duty of care for the product during the cancellation period, which includes it being sent back in the original, unmarked and undamaged packaging, or in a good enough quality transport packaging in order to avoid any damage during the transport back to our warehouse. Items must not have been used or assembled in any way.

Apart from few exceptions, which are listed below, you have the right to reverse any purchase made via this Website within 7 days after your receipt of the product and to receive a full purchase price refund, subject to being charged by the seller cost for the return of the product.

Exceptions: The following types of products may not be returned due to post-purchase-remorse:

  • Made-to-order items
  • Flat-packed items that have been partly assembled or fully assembled
  • Any item made of fabric, glassware, matrasses, mattress toppers, duvets and pillows
  •  Personalized items

NOTE: If you wish to return any non-defective product delivered to you for a refund, please do not remove the product from its original packaging. Remember that HomePoint may hold you liable for any damage you cause to the product (including its packaging) while in your possession.

7. Arranging returns

If you want to return a product you have purchased from HomePoint for any reason permitted in section 3, 4, 5 and 6 you must in all instances first notify HomePoint and to inform us of the reason for your return by contacting us via:

Once you have contacted us, we will get in touch with courier company to arrange collection and they will notify you of a proposed collection date shortly after. HomePoint will issue you with a returns authorization number (“RA Number”)

You must ensure that the Product to be collected by the courier is packed in compliance with the following:

  • The Product is properly protected;
  • The Items returned must arrive in original and re-sellable condition, together with all accessories, instructions and documentation (if any), and in perfect condition for the purposes of resale (i.e. the product must not be damaged, scratched, soiled, and in the case of electronic appliances, the adhesive screen covers must not have been removed, except where being returned due to being Defective,); and
  • The HomePoint issued RA Number is accurately reflected on the courier’s collection slip.

HomePoint retains the right to refuse a refund on any item not deemed to be re-sellable. Returns cannot be accepted once the assembly process has begun.

We do not accept responsibility for items lost and/or damaged in transit while being returned and your initial delivery charge will not be refunded.

Special Offers: If the product is no longer being offered at the special price advertised at the time of purchase, HomePoint will only be able to repair, not replace same.

Products returned without a valid RA Number will not have been validly returned and may be sent back to you at your expense.

8. Processing of returns

Should you be entitled to a refund for any reason, such refund shall –

a) In the case of payment having been made by credit card, be effected on the same credit card account, provided that if you are refunded on a credit card in respect of only a portion of any order placed by you, then any subsequent refunds processed in respect of that order will be credited to your HomePoint shopper profile in accordance with (b) below;

b) In other instances, be credited to your HomePoint shopper profile,

As refunds need to be processed by the banks, please note that the processing of refunds can take up to 5 working days from approval date.

General Terms relating to website use

The following terms apply to your general use of our website:

Access to our website is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our website without notice (see below). We will not be liable if for any reason our website is unavailable at any time or for any period. From time to time, we may restrict access to some parts of our website, or our entire website, to users who have registered with us. You are responsible for making all arrangements necessary for you to have access to our website. You are also responsible for ensuring that all persons who access our website through your Internet connection are aware of these terms, and that they comply with them.

We are the owner or the licensee of all intellectual property rights in our website, and, save for our users content (where we are licensee), in the material published on it. These works are protected by copyright laws and treaties around the world. All such rights are reserved. You may print off one copy and may download extracts of any page(s) from our website for your personal reference and you may draw the attention of others within your organization to material posted on our website. You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text. HomePoint (and that of any identified contributors) as the authors of material on our website must always be acknowledged. Commentary and other materials posted on our website are not intended to amount to definitive advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our website, or by anyone who may be informed of any of its contents.

We aim to update our website regularly, and may change the content at any time. If the need arises, we may suspend access to our website, or close it indefinitely. Any of the material on our website may be out of date at any given time, and we are under no obligation to update such material.
